NATURE OF ACCOMMODATION (NON-TENANCY DECLARATION) – PART 1

  • The accommodation provided by PM Residency is a temporary residential license facility only.
  • The resident shall not be considered a tenant under the Transfer of Property Act, Rent Control Act, or any tenancy laws.
  • The resident acknowledges that this agreement does not create any tenancy, lease, or ownership rights.
  • The resident only receives temporary permission to occupy the allotted room/bed, which can be revoked by management at any time for violation of rules.
  • The resident waives any claim of possession rights over the premises.

  1. Advance / Security Deposit

1.1 A refundable advance amount of ₹10,000 must be paid at the time of admission.

1.2 The advance amount will not be adjusted against:

  • Pending rent
  • Electricity charges
  • Damages to hostel property
  • Any other outstanding dues

1.3 The advance amount will be refunded only after clearing all dues and completing the mandatory notice period, subject to deductions if applicable.

1.4 The advance amount cannot be adjusted towards monthly rent during the stay.

  1. Pay and Use Rent Policy

2.1 The hostel operates on a Pay and Use monthly rental system.

2.2 Rent will not be calculated on a daily basis under any circumstances.

2.3 Rent calculation will follow the fixed half-month rule mentioned below:

2.4 Regardless of the joining date within these ranges, the rent will remain the same.

  • Examples:
  • Joining on 2nd → Full month rent
    Joining on 6th → Full month rent
    Joining on 15th → Full month rent
  • Similarly,
  • Joining on 16th → Half month rent
    Joining on 20th → Half month rent
    Joining on or after 25th → Fixed Rent 2500 ( Irrespective of the Sharing )

2.5 Requests for date-to-date rent calculation (example: 6th to 6th or 10th to 10th) will not be entertained.

2.6 The rent cycle for all residents will always be calculated based on the calendar month only.

  1. Payment at the Time of Admission
  • At the time of admission, the resident must pay:
  • Advance Amount – ₹10,000
  • Room Rent for the applicable period (as per month rule)
  • Admission will not be confirmed unless both payments are completed.

  1. Electricity Charges (EB)

4.1 Electricity charges will be divided equally among all residents staying in the room, regardless of the number of days each resident stays during the month.

4.2 Electricity will not be calculated on a daily basis.

4.3 Residents joining or leaving mid-month will still be responsible for their equal share of electricity charges for that month.

4.4 Electricity charges will be payable at the end of every month based on meter readings.

  1. Mess / Food Charges

5.1 Food charges, if applicable, will be collected at the end of the month.

5.2 Food service is an optional facility and not included in the room rent.

5.3 Food quality will be ensured, but quantity is limited and Menu is based on the food vendor and management is not responsible for the menu and customisation is not possible.

5.4 Food is to be consumed based on the allotted quantity, in case of any shortage, management is not responsible and we are not liable to arrange or deduct the food amount for not consuming.

  1. Minimum Stay Requirement

6.1 Every resident must complete a minimum stay duration of three (3) months from the date of admission.

6.2 If a resident vacates the hostel before completing the minimum stay period, the advance amount will be fully forfeited and no refund will be provided at any cause.

6.3 The resident acknowledges that the minimum stay condition is mandatory and non-negotiable.

  1. Mandatory Notice Period

7.1 Residents who wish to vacate the hostel must provide a minimum written notice of 30 days to the hostel management.

7.2 The notice must be given in writing or through an officially accepted communication method approved by management.

7.3 The notice period will start only from the date when the management acknowledges the notice.

7.4 If a resident vacates the hostel without giving the mandatory 30 days notice, the advance amount will be fully forfeited without any refund.

7.5 I agree to this terms and I won’t argue with the management at any cause or instances –

  1. Advance Amount & Refund Conditions

8.1 At the time of admission, a refundable advance amount of ₹10,000 must be paid.

8.2 The advance amount will be refunded only if all the following conditions are satisfied:

  • Minimum stay period of 3 months is completed
  • 30 days’ notice period is given
  • All dues are cleared
  • No damage to hostel property

8.3 A non-refundable administrative charge of ₹1,500 will be deducted from the advance amount at the time of vacating.

8.4 The remaining advance amount, after deductions, will be refunded within 7 to 14 working days.

The advance amount may be adjusted if applicable –

  • Pending rent
    • Electricity charges
    • Damage to hostel property
    • Cleaning or maintenance charges
    • Unpaid mess charges if applicable
  1. Immediate Vacating Without Notice

If a resident vacates immediately without notice:

  • The entire advance amount will be forfeited
    • The resident will not be eligible for any refund
    • Management reserves the right to recover any additional dues if applicable

11.Parking Rules

  • Only registered two-wheelers of residents are allowed, its based on the first come first serve basis, management cant allot the parking space based on discretion.
  • Vehicles must be parked in designated areas.
  • Management is not responsiblefor theft or damage.
  1. Wifi Rules:
  • Wifi is restricted to one user per device for the smooth usages and fair distribution of the resources, its accessible only based on the MAC Addresses, it will be added within 3 days of the MAC Registration.
  • Management is not responsible if the device is not working.

  • I confirm that I have clearly understood the Advance, Rent Calculation, and Electricity Sharing Policy, and all details in Part 1 is clear, and I agree not to request any daily rent calculations or exceptions or explanations

PART 2

  1. ADMISSION AND DOCUMENTATION

2.1 Admission (hand over of Keys etc )shall be granted only after submission of:

  • Government ID Proof (Aadhaar / Passport / Driving License)
    • Passport photographs
    • Parent / guardian contact details
    • Occupation / educational institution details

2.2 Management may conduct background verification or police verification if required.

2.3 If any information provided is false or misleading, management reserves the right to:

  • Cancel admission immediately
    • Forfeit any payments made and can take the legal actions.

2.4 Admission is strictly non-transferable.

Subletting, allowing outsiders to stay, or sharing the bed without permission is prohibited.

Penalty: ₹5,000 fine + immediate eviction

  1. FEES AND PAYMENT TERMS

3.1 The resident agrees to pay:

  • Monthly accommodation fee
    • Maintenance charges (if any )
    • Electricity charges
    • Optional mess charges

Other charges based on the needs or demands – Example: (During water scarcity water charges may be collected and other temporary charges based on the needs )

3.2 All payments must be made on or before 5th of every month, it doesn’t meant that your stay is till 5th.

3.3 Late Payment Penalties: Rs: 100 per day will be charged automatically if it exceeds 5th.

3.4 If payment is not received within 10 days:

Management reserves the right to:

  • Lock the room
    • Deny entry access
    • Suspend services
    • Terminate accommodation

3.5 Resident belongings may be retained until all dues are cleared.

  1. SECURITY DEPOSIT

4.1 A non-refundable security deposit of ₹1,500 must be paid at the time of admission / adjusted in advance at the time of vacating the hostel.

4.2 This amount covers:

  • Administrative processing
    • Cleaning after vacating
    • Maintenance or general depreciation
    • Minor repairs

4.3 The resident acknowledges that this deposit is non-refundable under any circumstances.

  1. ELECTRICITY AND UTILITIES

5.1 Electricity consumption inside rooms will be charged based on sub-meter readings.

5.2 Approximate tariff: ₹14.5 per unit, subject to change based on TNEB tariff revision.

5.3 Common electricity charges will be equally divided among all residents occupying or booking rooms, regardless of actual presence.

5.4 Utility charges include:

  • Water pumps
  • Corridor lighting
  • CCTV
  • Shared electrical equipment
  • Washing machines
  • Study areas
  • Dining
  • All the things that consumed outside the rooms ( that might vary time to time )

No arguments are entertained that, I am not using this facility and requesting to reduce the amount or arguing for the clarifications.

  1. ROOM ALLOTMENT

6.1 Room allocation is solely at the discretion of management.

6.2 Residents are not permitted to change rooms without written approval.

  1. DISCIPLINE AND CONDUCT

Residents must maintain respectful behavior within the premises.

The following actions are prohibited:

  • Verbal abuse toward staff
  • Threatening behaviour
  • Harassment
  • Physical fights

Repeated violations will result in immediate termination of accommodation without refund.

  1. PROHIBITED ACTIVITIES

The following activities are strictly prohibited:

  • Smoking
  • Drinking / or smoking inside and out side or near the premises
  • Persons who are drunk outside are also not allowed for stay
  • Alcohol consumption
    • Drug usage
    • Gambling
    • Illegal activities

  1. VISITOR POLICY

9.1 Visitors are not allowed inside resident rooms under any circumstances.

9.2 Visitors may meet residents only in designated common areas with management approval.

9.3 Overnight stay by visitors is strictly prohibited.

Penalty: ₹2,000 per violation

Repeated violations may lead to termination of stay.

  1. CURFEW AND ENTRY POLICY
  • Residents must return before 10:30 PM, after 10.30 at any cause residents wont be allowed to leave from property
  • Main gate and terrace access will be closed after this time.
  • Residents working night shifts must provide written employer confirmation.

PLUS actual replacement cost + Labour.

  • Based on the nature the fine will be imposed on Individual or the entire rooms.
  • In case of any damages in the common area, it will be levied for the entire floor.
  • In case of any damages to washing machine, floor heaters, it will be levied on entire floor or total residents.

  1. FOOD AND MESS DISCLAIMER

Food service is not part of the accommodation agreement.

It is only an optional facility arranged for resident convenience.

Therefore, residents cannot claim:

  • Refund
  • Compensation
  • Fee adjustment
  • Food quality complaints
  • Quantity dissatisfaction
  • Menu preferences

Food consumption inside rooms are strictly prohibited, can be consumed only in dining area

Penalty: ₹500/ instance

Repeated violation leads to termination with immediate effect.

  1. NOTICE PERIOD AND VACATING POLICY
  • Residents must provide 30 days written notice before vacating.
  • Failure to provide notice will result in:
  • 30 days rent charged as penalty
  • Before vacating:
  • All dues must be cleared
    Electricity charges must be settled
    • Damage costs must be paid
  • Unclaimed belongings will be disposed after 7 days.

  1. LIABILITY WAIVER
  • The management shall not be responsible for loss, theft, or damage to personal belongings.
  • Residents are advised to secure valuables with personal locks.
  • Management is not responsible for the belongings kept on the mattress, in case any loss or damages, the risk must be beard by the resident only.
  1. INDEMNITY CLAUSE
  • The resident agrees to indemnify and hold harmless PM Residency, its staff, and management against:
  • Damages caused by the resident
    Legal claims arising from resident misconduct
    • Violations of law within hostel premises
  1. MANAGEMENT AUTHORITY
  • Management reserves the right to:
  • Modify rules at any time
  • Impose fines for violations not listed here ( it can be added later based on time to time, and fine will be started from Rs:500 minimum and can extend to maximum
  • Terminate accommodation immediately for misconduct
  • Management decisions shall be final and binding. Arguments are not entertained at any cause

  1. CCTV AND SURVEILLANCE
  • The premises are monitored by 24×7 CCTV surveillance.
  • Residents consent to monitoring for safety and security. Play backs will be given only based on the written request, only for the valid reasons & not immediately.
  1. NON-LITIGATION CLAUSE
  • The resident agrees not to initiate unnecessary disputes or complaints against the hostel management regarding policies clearly mentioned in this agreement.
  • Any disputes shall be subject to jurisdiction of courts located in – Coimbatore, Tamil Nadu

FINAL DECLARATION

I confirm that I have read, understood, and accepted all the terms stated above and the terms are not subjected to this sheet, all the terms mentioned in invoices, website, verbal communications or through any medium.
